Terms of service
DRAFT — must be reviewed by a lawyer before launch.
Last updated: [DATE]
1. About these terms
These terms apply when you use Inkantation (the “service”), run by [COMPANY NAME], [COMPANY ADDRESS], [REGISTRATION NUMBER]. By creating an account or placing an order, you agree to them. Please also read our privacy policy.
2. Your account
- You must be at least [16] years old, or have permission from a parent or guardian.
- Keep your sign-in details safe. You're responsible for what happens in your account.
- Please give correct information. We may suspend accounts that break these terms or misuse the service.
3. Creating designs with AI
- Designs are made by AI from what you describe. Results can be unexpected, and similar ideas may lead to similar designs for other people, so we can't promise a design is unique.
- Free accounts have a daily limit on AI actions, and we may pause free AI use at times (for example when the daily budget is used up).
- The AI refuses some requests, such as famous characters, brands, real people, or unsafe content.
- Please check every design carefully before you order (spelling, placement, colors). What you approve is what we print.
4. What you upload, and your rights
- You must own, or have permission to use, everything you upload — images, fonts, logos, photos, and text — for printed products. This includes the rights of artists, photographers, font makers, and anyone shown in a photo.
- You must not upload or create anything that is illegal, hateful, harassing, sexually explicit, violent, or that misleads people.
- You keep the rights you have in your uploads and designs. You give us permission to store, process, and print them, and to share them with our providers (such as our AI and printing partners), only as needed to run the service and fulfill your orders.
- If someone claims that something you uploaded or ordered breaks their rights, you agree to take responsibility for that claim [LAWYER: indemnity wording and limits].
5. Designs we may refuse
We may refuse, cancel, or remove any design or order that we believe infringes someone else's rights (such as copyright, trademarks, or personality rights), breaks the law, or breaks these terms. If we cancel a paid order for this reason, we'll refund it. Rights holders can report a design to [CONTACT EMAIL].
6. Orders, prices, and payment
- Prices are shown in US dollars. Shipping is shown at checkout before you pay. [LAWYER: taxes/VAT wording for EU customers.]
- An order is accepted once payment succeeds and we confirm it. We may cancel and refund an order if there's a mistake in the price or a problem we can't fix.
- Products are made to order by our production partner, Printful, and shipped to the address you give.
- Delivery times are estimates. See shipping. Customs or import fees, if any, are paid by the person receiving the order.
7. Returns and problems
Because every product is custom made, there's no right to return it because you changed your mind. [LAWYER: confirm the EU right-of-withdrawal exception for personalized goods.] Damaged, faulty, or misprinted products are reprinted for free or refunded; see our returns policy.
8. Our website
The website, its look, and its software belong to us or our licensors. Please don't copy it, attack it, overload it, or use automated tools to access it (for example to create designs in bulk).
9. Responsibility
We provide the service with care, but we can't promise it will always be available or free of errors. To the extent the law allows, our total responsibility for any order is limited to what you paid for it, and we're not responsible for indirect losses. Nothing here limits rights you have under consumer law that can't be excluded. [LAWYER TO REVIEW.]
10. Changes and ending
We may update these terms; the date above shows the latest version, and important changes will be announced. You can stop using the service and ask us to delete your account at any time.
11. Law and disputes
These terms are governed by the laws of [JURISDICTION]. If you live in the EU, you also keep the protection of the consumer laws of your country. [LAWYER: courts, EU Online Dispute Resolution information.]
